TERMS AND CONDITIONS 

    The New Zealand Innovation Awards are organised by New Zealand Innovation Council Limited (NZIC).

     

    1. Eligibility

    a) Entry is open to individuals and businesses.

    b) Individuals must be either New Zealand citizens or permanent residents aged 16 and over at the time of entry. Employment or any relationship to an existing company, body corporate or society or organisation of relevance must be declared on your application.     c) Businesses must be companies registered in and have operations in New Zealand.

     

    2. Award Competition Dates

    a) Entries open on 6th June 2017 and close at 5pm on 28th July 2017.

    b) Finalists will be announced on 5th September 2017.

    c) Winners will be announced at the Awards ceremony held on 19 October 2017 in Auckland.

     

    3. To Enter

    a) Where a submission is created by a team, the team must identify one person on the entry form as its representative. The representative will have authority to act on behalf of the team and will be the point of contact for all communication with NZIC.

    b) Entrants take full responsibility for the content of their submission. 

    c) A submission may be entered in up to 3 industry categories. There are a total of 10 industry categories. They are listed on our website at www.innovators.org.nz.

    d) NZIC will not consider or may subsequently disqualify submissions that:

    • Are contained in electronic files that are corrupt, damaged, lost or inaccessible by NZIC;

    • Contain defamatory, malicious, offensive, fraudulent or unlawful content;

    • Infringe the intellectual property rights of others;

    • Are illegible or incomplete;

    • Do not comply with these terms and conditions.

    All submissions are subject to moderation by NZIC

    e) NZIC may exclude entrants, withhold or request return of prizes if they breach any of these terms and conditions.

    f) A fee of $75.00 + GST must be paid for each submission entered online.

    g) Finalists will use all reasonable efforts to attend the Awards ceremony in Auckland on 20 October 2016 so they can accept their award(s). 

    h) Finalists will give NZIC at least one week notice in writing if they are unable to attend the Awards ceremony.

    i) Finalists must also:

    • Ensure they have provided valid and up to date contact details, photos and personal profiles;

    • Comply with all reasonable instructions from NZIC relating to public relations and promotional activities before and after the Awards ceremony, including requests for interviews. 

     

    4. Rights and Licenses 

    a) By entering, entrants warrant that:

    • They are the original author(s) of their submission;

    • They own all intellectual property rights, including copyright rights in and to all materials submitted and/or that they are authorised to use these rights;

    • The submission does not infringe any third party's intellectual property rights or other proprietary rights, including copyright, patent, trade mark, trade secret, design.

    b) NZIC’s decisions are final in all matters relating to this competition and no correspondence will be entered into.

     

    5. Acceptance by Entrants

    a) By entering, entrants accept these Terms and Conditions and agree to be bound by them and any subsequent reasonable instructions or decisions of NZIC or the evaluators.

    b) By entering, all entrants agree that non-confidential information and material, such as names, photographs, images, videos or written material as disclosed to NZIC may be reproduced, published and used by NZIC in relation to this competition, including for promotional purposes (including in print and on NZIC’s websites). NZIC will use all reasonable efforts to contact entrants and obtain their consent before disclosing any of the above information to third parties. Any such use will be entirely at the discretion of NZIC.

    c) Entrants warrant that they have the legal right to authorise NZIC to so use all disclosed information and material.

    d) NZIC will comply with the Privacy Act 1993 in relation to any personal information you supply to it.

    e) By entering, entrants consent to becoming a member of the New Zealand Innovation Council at no cost, and accordingly to receiving targeted and relevant information about innovation and business growth. Entrants may unsubscribe from this service at any time.

     

    6. Limitation of Liability 

    a) Entrants warrant they are eligible to participate in the competition and agree to release, indemnify and hold harmless NZIC and all associated third parties in the competition and their respective directors and employees from and against any and all losses, claims, liability and damages of any kind, brought against any of them, as a result of their breach of any of these terms and conditions, their participation in the competition, or acceptance or usage of any prize or award.

     

    7. Governing Law and jurisdiction

    a) These terms and conditions are governed by and will be interpreted in accordance with the laws of New Zealand and the Courts of New Zealand will have exclusive jurisdiction.

     

    8. Confidential Information

    a) NZIC will treat any and all Confidential Information in the strictest confidence. It will not, without the prior written approval of the entrant, use any part of the Confidential Information other than for the purpose of the competition.

    b) Confidential Information means all material and information pertaining to the entrant and their submission and includes:

    • all information and materials relating to the concept, design, development, materials and research relating to the content disclosed in the submission, including but not limited to all drawings, specifications, technical information, research and development details, product analysis, compilations, documents, records, notebooks and similar material in any form whatsoever;

    • all information relating to the business affairs of the entrant, including any marketing plans, business plans, and financial information;

    • information which is by its nature is confidential or which the entrant advises is confidential. 

    c) Information shall be deemed confidential whether or not it is identified as such at the time of disclosure.

    d) The term Confidential Information does not include information which:

     • at the time of entry is in the public domain or subsequently enters the public domain without fault on the part of NZIC;

     • is received in good faith by NZIC from a third party, which party is lawfully in possession of the same and had the right to disclose that information;

     • is, at the time of entry already lawfully in the possession of NZIC and can be demonstrated by written record to be previously known to NZIC;

     • is required to be disclosed to a governmental agency or otherwise by law; or

     • the entrants indicate in writing is not confidential.
